NEWSGROUPS
Newsgroups are cyberspace versions of community bulletin boards. In this
case, the community is global! You can post messages on these
bulletin
boards and read messages that others have posted. Each newsgroup on the
internet has a designated primary topic, so that you can find groups that
discuss topics in which you are interested. Read what people all over
the world have to say about these topics, state your own opinion, ask questions
and get advice.
Watson Online makes all newsgroups available to you at all times.
When you subscribe to a newsgroup, you don’t actually begin receiving
that group because you receive them all, all of the time. Subscribing to
a group
merely means that the articles in that group will be displayed to you automatically.
You’ll probably keep your subscribed list small and limit it only
to the groups that you find most interesting.
To receive Newsgroups, go to our support site, www.broadbandsupport.com.

4. Service and Repairs

related to the Service in a timely manner. Watson Online will attempt
to correct interruptions
of Service, due to technical malfunction, at Watson Online’s expense.
The cost of such correction may be billed to the Subscriber if the repair
requires
a Subscriber site visit that is determined in Watson Online’s sole
judgment to be a result of Subscriber negligence, lack of knowledge, software,

repairs or replacement will be at Subscriber’s expense. We do not troubleshoot
and/or repair computers, routers or home networks.
a. Service Availability
Watson Online will make reasonable efforts to assure that the Service will
be available to you 24 hours per day, 7 days per week. It is possible,
however, that there will be interruptions of service. You acknowledge and
agree that
the Service may be temporarily limited, interrupted or curtailed for many
reasons,
including without limitation, limitations of either your or our equipment
software/hardware, forward error correction overhead (FEC), 10Base-T Ethernet
connections to your
PC, network traffic or other technical glitches or malfunctions, system
capacity limitations imposed on or experienced by the underlying communications
carriers,
governmental action, acts of God or other reasons beyond our control, equipment
or systems failures or modifications, upgrades, maintenance, repairs or
similar activities required or appropriate for the delivery or improvement
of Service.
In the event of a complete failure of Service due to technical malfunction
for twenty-four (24) consecutive hours or more, Customer is entitled to a
prorated credit upon request. To qualify for an adjustment, Customer must
request a
credit
within thirty (30) days of the failure.
Watson Online shall have no liability for interruption of Service due to
circumstances beyond its control, including without limitation, acts of
God, natural disaster,
regulation or Government acts, fire, civil disturbance, strike or weather.
b. Finite Bandwidth
Cable modem service is provided over a shared network. The bandwidth used
by the Cable Modem Service coexists with cable television service using
the same
facilities. You and all the other users share a large but still limited,
amount of bandwidth. As a result, depending, among other things, upon the
intensity
of customer use of the cable modem service and the time of day you use
the cable modem service, the bandwidth available to you, and the speed
of the
Service, will not always be at optimum levels. Watson Online does not guarantee
any particular
amount of bandwidth. We will, however, manage the cable modem service to
provide appropriate bandwidth for as many customers as is reasonably practical.
We
monitor
usage of our network, and will increase bandwidth as it becomes necessary.
c. No Liability for Content
We supply access to the internet through the Cable Modem Service, but we
are not the publisher of any information provided by others through the
Internet other than the information on our web site. We do not review,
censor, or monitor
any programs or content sent or accessed over the Internet or made available
by any individual, user, information provider, on-line service or content
provider.
Such content or programs may include, without limitation, programs or content
of an infringing, abusive, profane or sexually offensive nature. All content
from other parties accessed via the Service is accessed by you and those
you have authorized, all at your own risk. We are not in any manner responsible
for such content or programs. We assume no liability whatsoever for any
claims, losses,
action, damages, suits or proceedings arising out of or otherwise relating
to such content accessed using the Service.
d. No Liability for Viruses
Files downloaded from the internet and /or the World Wide Web, any internet
service, content or other on-line service provider, or other information
provider, may
contain corrupted, damaging, or self-executable files that could corrupt,
destroy, or otherwise damage data, files, software and/or hardware on your
home computer.
Typically, these are called “viruses”.
We make no representation or warranty that any software and/or files you
may download from the Internet, the World Wide Web, or any other Internet
Service
Provider, content provider, on-line service provider or other information
provider is free from any virus or other damaging or destructive attribute.
We have
no responsibility, and assume no liability for such acts or occurrences.
e. No Liability for Unauthorized Access
Because the service is a shared network, and because it provides access to
the internet and the World Wide Web, it is possible that others may access
or monitor
the data you send and/or receive to and/or from the Internet and /or the
service. Also, the Internet uses facilities that are generally used for public
access
to transmit voice and data communications. For these reasons, the Service
may not be completely private or secure.
Accordingly, we do not warrant that any data or files you send over the
Service and/or receive through the service will be free from unauthorized
access
by others, or that other users (often called “hackers”) would
be unable to gain access to your computer. You agree that we are not liable
for any claim, loss,
damage or costs that may result from your lack of privacy or breach of
security on or through the Internet and/or World Wide Web or otherwise
through your
use of the Service. If you choose to run applications from your computer,
that permits
others to gain access to it, you must take appropriate security measures.
Failure to do so may cause immediate termination of the service by us.
We are not responsible
for and assume no liability for any damages resulting from others accessing
your computer.
f. Peer to Peer Networking
The Service is typically configured NOT to permit peer-to-peer networking
or file sharing. There are extreme security risks to your computer and
privacy of your data and files associated with peer-to-peer networking.
In addition,
peer-to-peer
networking places undesirable demands on the Service’s shared bandwidth.
5. Indemnification
Subscriber agrees to defend, indemnify and hold harmless, Watson
Online, Watson Cable Company, and its affiliates and third party
content
and service providers
and their respective officers, directors, employees and agents, from and
against all claims and expenses, including attorney’s fees, arising
out of the use of the Service by Subscriber or otherwise arising out of the
use of the Subscriber’s
account.
6. Miscellaneous
This agreement and any operating rules for the Service established
by Watson Online now or hereafter constitute the entire agreement
of the parties with respect
to the subject matter hereof, and supercede all previous written or oral
agreements between the parties with respect to such subject matter; provided
that any
other special pricing agreement or subscription or customer agreement relating
to Customer’s
cable television service with Watson Cable Company shall remain in full force
and effect. Acceptance of Service or execution of this agreement shall constitute
acceptance of the terms and conditions herein. This Agreement shall be construed
in accordance with the laws of the State of Georgia, without regard to its
conflict of laws rules. In the event that any portion of this agreement is
held to be
invalid or unenforceable, the invalid or unenforceable portion shall be construed
in accordance with applicable laws as nearly as possible to reflect the original
intentions of the Parties set forth herein, and the remainder of the Agreement
shall remain in full force and effect. No waiver by either Party of any breach
or default shall be deemed to be a waiver of any preceding or subsequent
breach or default.
